Colibri is a small collective of friends, instructors, students, and other people interested in learning or developing holistic communal and personal skills achieved by education and experience in mind, body, and spirit through methods such as Tibetan sound practices, yoga, aerial yoga, gardening, meditation, and other means of communal or personal growth and development. Participation is grounded in a quiet, refined, and relaxed atmosphere of reflection, exercise, and sharing of knowledge. Participants must assume the risk of all harm that might occur when entering the property or participating. I am requesting that my minor child participates in activities. I consider and agree to the following:

I agree to monitor and observe my child’s activities while on the property or engaged in activities. I understand that no one provides childcare or monitors my child, that my child’s participation is at my request, and that this release and waiver applies to my child.

Activities occur in an outdoor garden, terrace, and patio having hills, sloped walkways, stairs, variable surface materials, and uneven walkways. The areas are not designed for public access and may contain unexpected hazards. Before participating in an activity, I agree to carefully examine the walkways, access areas, slopes, and areas where activities occur or are accessed.

Any physical exercise, like low-impact yoga or aerial yoga, carries a risk of injury. Since those involved with Colibri are not medical professionals and do not provide medical advice, I understand and know my child should not participate in an activity in which I know he or she could be harmed or where my child might exceed their limits of strength or skill. I acknowledge that I am the best judge of their abilities and will monitor their conduct accordingly.

I understand that I should speak with my child’s doctor or healthcare professional before my child engages in any activities. An informed participant can avoid over-exertion or engagement in activities that might result in an unwanted injury.

If I participate in any activity in which an instructor or other person is leading or advising my child, I agree to notify the person of any health conditions which might affect my child’s ability to participate. If at any time I feel my child cannot achieve or participate in physical activity or becomes uncomfortable, I will immediately stop the activity and assess whether my child should continue.

Activities are usually performed outdoors. I recognize that participating in any outdoor activity carries the risk of exposure to insects, sunlight, adverse weather, noxious plants, animals, pesticides, and allergens. I know each of these might cause my child harm, serious injury, or death. Before entering the property, I agree to let Colibri, my instructor, or the leader know if I have any concerns regarding these or any other risks that might cause my child harm. I understand that medical treatment is not provided on-site. If my child requires special medication (such as asthma treatment, emergency epinephrine, or pain relievers), I will bring such medications with me.

Before my child can participate with Colibri or enter the property upon which activities occur, I agree and acknowledge that I am assuming all the risks of my child’s participation. By signing this form, I am acknowledging that I understand the risks and recommendations above, and I have asked any questions I feel are important to protect my child’s safety and well-being. ​I understand that when I enter the activity area or participate in an activity, I am assuming the risk of all injuries my child might sustain. I understand injuries can occur by any means, including tripping, falling, insect bites or stings, animal bites, sunburn, dehydration, plants, injury from weather, equipment malfunctions, uneven surfaces (including walkways), as well as harm specific to an activity. By assuming the risks of all injuries my child might sustain, I understand and agree that I can bring no claim or lawsuit against Colibri, instructors, participants, or anyone else I believe may have contributed to or is responsible for my child’s harm. Particularly, I agree, and now I, for myself and my child, waive, release, and forever discharge any individual, company, or property owner (including Colibri, Abal Soledad, Abal Trust, Claudia Vallarta, and any other person I believe responsible for any injury or claim I have or might have) who promotes, facilitates, conducts, teaches, coaches, or participates in any activity, and from any and all liability, claims, demands, or assertions of responsibility. I understand and agree that this waiver and release extends to my family members or others who might make a claim on my behalf or on behalf of my child. If any dispute arises as to any liability, I agree that this release and waiver should be interpreted broadly to encompass any and every claim or liability my child or I might assert.

I agree these activities are public, and I have no expectation of privacy. Security or surveillance cameras may be in use. I acknowledge participants may take pictures or videos of activities and post those to social media sites. I waive any right to assert a claim of appropriation of my likeness, invasion of privacy, or any other claim related to posting of my image online.

To enable the tranquility, peace, and solitude required of activities, I understand and acknowledge that my child’s behavior should be calm, quiet, and consistent with the activities in which they are engaged. Dangerous or disruptive conduct will not be tolerated. I understand that Colibri or my child’s instructor or coach– at their sole discretion and for any reason – may determine that my child should no longer participate. I agree that, upon demand, I will immediately remove my child from the premises. I understand and agree that my child has no right to participate in any activity and that I have no right to claim or demand his or her participation in any activity.

As with any activity in which my child is in proximity to other people, I understand there is a risk of exposure to COVID-19 or other airborne illnesses. By signing this release, I assert that my child has not been diagnosed with any communicable disease within the past fifteen (15) days. I also agree that my child will refrain from participating in any future activity if he or she has any symptoms such as runny nose, cough, congestion, diarrhea, or symptoms known to be associated with airborne illnesses.
